12th share: Code of Professional Responsibility

Hello,

Right now there are no words that directly describe what I'm feeling right now, though I know it's much harder on your part, especially those who are going to take the examinations.

Anyway, please don't take it against me if you find all what I uploaded here inappropriate, it's the best I can do. I really can't make it any better for some of you out there since that would require time and professional technical expertise. The reason why I decided to make all these and share is because from what I've obtained so far the quality of those audio materials don't seem to sound as natural as this one - which is the reason why for those who sell those audio CDs there in the review area and they cost a penny but with good reason.

So my share today is the Code of Professional Responsibility.

The code of professional responsibility is defined aptly by the free dictionary as:

"Code of Professional Responsibility n. a set of rules governing the ethical conduct of attorneys in the practice of the law. It covers such topics as conflicts of interest, honesty with clients, confidentiality, and conduct toward other attorneys and the courts. First developed and pushed by the American Bar Association the code has been adopted by most states." Link Here.

Though the description above would refer only to that of the American Bar Association, but bear in mind we also borrowed some ideas from the United States.

So, the link:

I chose to make it into this because not everyone has winrar or winzip installed into their Operating System. However, you may scan with your favorite AV just to make sure.

11th share: Revised Penal Code of the Philippines Book 2

Hi guys,

This post is for the 2nd part of the Revised Penal Code. This post contains book 2 which lists specific crimes punishable by laws here in the philippines. Anyway to cut to the chase, I just hope I posted this in time for those who are going to take the Bar examinations.

Please, take this and use it and include me in all your prayers. This I dedicate to all those who are going to take the said examinations.

To make it short here is the file itself:

10th share: Revised Penal Code of the Philippines Book 1

Hey guys,

It's bar season already and the whole atmosphere seems calm. Everybody is preparing themselves to go Manila. I can imagine everyone gearing up and preparing themselves for one of the most grueling, most demanding challenge of their lives. Like a soldier going of to war he says his graces, say last words to his loved ones, invokes his prayers and bids everyone good bye. There seems to be a calmness within him, a fit of acceptance into a rite of passage most would not even bother to sacrifice life and limb - for four years of tirelessness and humiliation coupled with one year of realizing what they put themselves into. But nobody knew life itself without licking their own wounds of defeat and mistake, for life itself perseveres more under constant threat of pain and suffering. And those who have been wronged before by experience look back and say to themselves that whatever it was, it definitely was worth it.

OK. Enough of that, here's another one of my shares to you guys. Yes I know this has been long overdue but it's been quite a busy week. Just got through midterms and the results don't seem so encouraging, but anyway the show must go on.

My share this time is the Revised Penal Code of the Philippines Book 1. Here's what the RPC is for those who don't know:

From wikipedia:

"The Revised Penal Code contains the general penal laws of the Philippines. First enacted in 1930, it remains in effect today, despite several amendments thereto. It does not comprise a comprehensive compendium of all Philippine penal laws. The Revised Penal Code itself was enacted as Republic Act No. 3815, and some Philippine criminal laws have been enacted outside of the Revised Penal Code as separate Republic Acts." Full Text

9th Share: Family Code of the Philippines

Hey,

It is quite boring doing nothing but study(who would not notice anyway).  Even just months of just starting law school it seems to me there's nothing left of my life anymore except the fact that I am still alive and breathing and a tad smarter when it comes to the law - but only here in the Philippines.

But I'd fool myself from time to time thinking these lesser beings should look up to me because not everyone has what it takes to go to law school let alone become a lawyer mwahahahahahaha *evil grin*. Seriously, that's how I sometimes cope with the pressure and the boredom associated with the legal profession. Sure some of you might say it's not like that... but really... I'd give you the benefit of the doubt. Well, at the end of the day I know I'll get passed this and wake up one day at the right side of my bed... smiling for no apparent reason at all.

Well, if you are reading this then I guess you had the patience of going through my mini-rant there. If you got a problem with that I don't give a damn. But I must say you should be proud you read this far into this blog post, because this is the part where I give you the download to the file that I just made into audio. So... here it is ladies and gentlemen.

Of course before I give you the link, I should give a brief overview on what it is.

From wikipedia(for the lazy ones out there like me):

"In 1987, President Corazon Cojuangco Aquino enacted into law The Family Code of 1987, which was intended to supplant Book I of the Civil Code concerning persons and family relations. Work on the Family Code had begun as early as 1979, and it had been drafted by two successive committees, the first chaired by future Supreme Court Justice Flerida Ruth Romero, and the second chaired by former Supreme Court Justice J. B. L. Reyes. The need was seen to amend the Civil Code through the Family Code in order to, among others, change certain provisions implanted from foreign sources which had proved unsuitable to Filipino culture; and to attune to contemporary developments and trends.

The Family Code covers fields of significant public interest, especially the law on marriage. The definition and requisites for marriage, as well as the grounds for its annulment, are found in the Family Code. Also in the Family Code is the law on conjugal property relations, the rules on establishing filiation, and the governing provisions on support, parental authority, and adoption."

8th Share: Revised Rules of Criminal Procedure

Apparently I could not wait until next day until I could upload this being due to the fact its been quite a long time since I have updated this blog. There's been a lot going on lately, especially here in my home country, it really is a bittersweet feeling knowing what just transpired this past few days. What I am talking about is the hostage-taking situation that happened last monday, August 23,2010. Of course you already knew about, it is all over the news. And to add to that there was also the blunder by our Ms. Universe Representative, though its best we just give her the benefit of a doubt as nervousness and excitement is not something she can control(LOL, what the heck am I talking about now). But anyway, that was the past it would be best not to dwell on it anymore.

So anyway, this is my 8th share - the revised rules of criminal procedure. As previously stated in my 7th share this is also for those involved in philippine legal processes  - be it law student, lawyers, judges, etc. The rules of criminal procedure guide how one shall take criminal actions as mandated by the Philippine Justice System. I can't be anymore detailed on this one, but so far this is the most updated version I could find so far. If you have anything to add, don't hesitate to go to the contact page of this site and send me an email or something. Whatever works, definitely works.

7th Share: 1997 Rules of Civil Procedure

Hi,

Apparently I really don't have much to do right now, so I might as well make use of my time here on my blog. Here is another share I am going to post for today. This share is already due way past and I am quite sure you won't be disappointed with what I am going to upload here. Anyway here's my latest share. It's the 1997 Rules of Civil Procedure.

As you know the 1997 Rules of Civil procedure governs how civil actions shall be handled here in the philippine courts, apparently this share is only for those law students studying here in the Philippines, i've yet to get materials from other nations wherein I may have them transcribed into audio and uploaded here for everyone else to download.

Just click on the link below to download the file. Enjoy.

6th Share: Insurance Code of the Philippines

Hi,

It's been a busy week lately. I just recently finished our midterm examinations because there is still one more exam left tomorrow. Seems to suck considering that tomorrow is going to be a holiday here which is National Heroes day, but apparently there seems to be no choice considering we are way behind schedule with respect to the other classes.

Anyway, to not keep you waiting here's another one of my audio transcribed shares.

This is presidential decree 612 - Insurance Code of the Philippines.

Here is a short overview of PD 612 from the site http://insurance.i.ph/

"The first insurance code in the Philippines was ordained and instituted under Presidential Decree (PD) no. 612 on December 18, 1974 by then President Ferdinand E. Marcos.

The forerunner of this code was the Insurance Act which took effect on July 1, 1915, and which was copied almost verbatim from the California Insurance Act, with the exception of a few provisions which were adopted from the New York Law." Read Full Entry Here: http://insurance.i.ph/

5th Share: 1987 Constitution of the Philippines

Hello,

It's me once again with another share. This time it's the full provision of the 1987 constitution. Hmm... that had me thinking, what does the US constitution look like? Well, I googled around and found a copy. And yes, the philippine constitution is indeed longer compared to that of the american counterpart. And also, I heard that it has not been changed since the last 200 years. Ours changes every now and then, probably less than 50 years it changes.

But anyway, I'm not the authority to comment on that. So, without further delaying the inevitable:

What is your learning style?

Hello,

There are multitudes of times when I can't seem to find the right mix of strategies to study. Most professors at school suggest to read and read the material again and again. Try as anyone might, this idea does sound promising, but there are some who are not able to adapt to this learning style. In the end, those who don't get by with this method end up frustrated and disappointed. Eventually they may choose to quit school or lose their focus by engaging in activities that are not helpful at all. However numerous studies, if not actual experiences of persons studying have made developments into learning how people learn. And to make it more encouraging, the study actually found out that not all people are capable of learning new material using the same method.

So, check this survey and see what your learning style is: Learning Styles
